최근 美 ‘국기에 대한 맹세’ 違憲 판결 기사를 읽고   글쓴이 : kopsa     날짜 : 05-09-22 06:59     조회 : 5399     최근 美 ‘국기에 대한 맹세’ 違憲 판결 기사를 읽고  미국 공립학교의 종교적 충성서약 문제는 “스켑틱스 뉴스”에 최초 2002년 7월 9일 게시했고 2004년 6월 27일 추가하여 美 대법원의 최종 판결을 게시한 바 있습니다. 의사이며 변호사인 마이클 뉴다우(Michael Newdow)라는 비종교적 인본주의자의 이야기입니다. 그는  딸을 대신하여 “하나님의 가호아래 한 국가”(one nation under God)가 들어간 충성서약의 위헌 여부를 가리기 위한 소송을 제기했는데 미 대법원은 뉴다우가 딸의 교육에 대한 결정권이 없다는 이유로 소송을 기각했습니다.  1. 최근 연합뉴스, 조선일보 보도 2005년 9월 14일 경, 비종교적 인본주의자 반경에서는 “충성서약”이 다시 위헌으로 판결났다는 뉴스가 돌았습니다. 이 뉴스를 앞서 글에 추가하여 게시하려다 우연히 아래 첨부한  연합뉴스와 조선일보 기사를 발견했습니다. 특파원들이 보낸 기사입니다. 이 새로운 뉴스가 무엇인지를 신문 기사의 오류와 함께 살펴봅니다. 연합뉴스는 2005년 9월 15일 “美연방법원, 국기에 대한 맹세는 위헌”이라는 제목의 보도를 했는데 “캘리포니아주 새크라멘토 소재 연방법원의 로런스 칼튼 판사”가 충성맹세의 “하느님의 가호 아래 단일 국가“라는 말이 헌법상 정치와 종교를 분리해야 한다는 원칙에 위배된다고 판시했다는 내용입니다. 그리고 앞서 3년 전 마이클 뉴도우씨가 제기했던 소송을 언급한 다음에 이렇게 이번 소송에 대해 적었습니다. “변호사이자 의사인 뉴도우씨는 당시 3명의 학부모 및 학생을 대표해 제소했음에도 대법원이 거부했었는데, 칼튼 판사는 이날 ‘그들 가족 모두 제소할 권리를 갖는다’면서 대법원에 정면으로 맞선 판결 배경을 설명했다.” 3년 전에 뉴다우는 딸을 대신하여 소송을 제기했습니다. 이때 대법원은 딸에 대한 보호 권리가 이혼한 부인에게 있다고 하여 소송을 기각했습니다. 연합뉴스의 “당시 3명의 학부모 및 학생을 대표해 제소했음에도 대법원이 거부했었는데”는 오류입니다. 대법원에서 소송이 기각 당하자 뉴다우는 처음부터 다시 시작했습니다. 그래서 3명의 학부모와 학생을 대신해 다시 위헌 소송을 제기했는데, 아래 CBS 기사에 의하면 이 3명의 학부모 가운데 다시 뉴다우가 포함된 것처럼 보입니다. 여하튼 제9 순회 연방법원은 이들 이름을 밝히지 않은 학부모가 자식에 대한 권리가 있다고 하며 충성서약의 위헌 판결을 내렸습니다. 2005년 9월 16일 조선일보의 “美 ‘국기에 대한 충성맹세’ 違憲 판결”은 칼튼 판사가 충성맹세문 가운데 “하느님의 가호 아래 하나의 국가”라는 부분은 헌법의 정교(政敎)분리 원칙에 어긋난다고 판결했다는 같은 내용입니다. 그런데 “소송을 제기한 무신론자(無神論者)이자 변호사인 마이클 뉴도씨”라는 표현은 3년 전 소송에 적절합니다.    2. 소송의 향배 아래 첨부한 CBS 기사를  참조하시기 바랍니다. 이번 판결은 소송 학생들이 다니는 캘리포니아주 새크라멘토에서의 판결입니다. 다시 말해서 판결은 이 지역에만 미친다고 합니다. 물론 이 소송은 항소될 것입니다. 이 경우 샌프란시스코 제9 순회 항소 법원에서 이기면 이 판결은 9개의 서부 주에 적용되고 대법원에서 최종 승소하면 모든 주에 적용됩니다.  대법원에서 승소할 수 있을까요? 모릅니다. 충성서약의 “하나님의 가호아래 한 국가”의 해석에 달려 있는데, 버지니아 리치몬드의 제4 순회 항소 법원에서는 충성서약을 규정한 버지니아법을 지지했다고 합니다. 그러니 결국 대법원까지 갈 수 밖에 없는데, 버지니아의 경우 충성서약이 기도와 유사한 종교적 표현이 아니라 애국적 행사이며 “하나님의 가호아래”가 들어갔다고 해서 애국적 활동으로서의 서약의 본질을 변화시키는 것이 아니라고 판결했다고 합니다. 3. 결론 이 충성서약 문제는 미국만의 문제가 아닙니다. 우리나라의 애국가에도 “하느님이 보우하사”가 있지 않습니까? 신앙적 인간의 일반 신으로 해석돼야 할 것인데, 이 경우에도 무신론자에게는 이해가 되지 않을 것입니다. 그리고 큰 문제는 김진홍 목사의 큐티(QT)에서 발견하는 것과 같이 기독교인이 애국가의 “하느님이 보우하사”를 우연이 아닌 “이 나라가 앞으로 기독교로 인하여 빛나는 역사를 이루어 나가게 하시려는 하나님의 섭리 중에 이루어진 일일 것이다”라고 말하는 것입니다. 이것은 합리적 사고가 아닙니다. 스켑틱스는 종교적 도그마를 다루지 않지만 이런 문제는 짚고 넘어가야 할 것입니다.   ................................... *첨부 1 美연방법원, "국기에 대한 맹세는 위헌" [연합뉴스 2005.09.15 10:33:32]         (로스앤젤레스=연합뉴스) 장익상 특파원 = 미국 공립학교에서의 국기에 대한 충성 맹세는 종교적 색채 때문에 위헌이라는 판결이 또 나왔다. 캘리포니아주 새크라멘토 소재 연방법원의 로런스 칼튼 판사는 14일(이하 현지시간) "학생들이 국기를 앞에 두고 낭송하는 충성 맹세문 가운데 `하느님의 가호 아래 단일 국가(one nation under god)''라는 말은 헌법상 정치와 종교를 분리해야 한다는 원칙에 위배된다"고 판시했다. 이번 재판은 `학생들이 강압적으로 종교를 갖는 것으로 부터 자유로워야 한다''고 주장하는한 무신론자가 제기해 이뤄졌으며 칼튼 판사는 지난 2002년 연방 제9 순회 항소법원이 내린 판결을 원용했다고 밝혔다. 3년전 역시 무신론자인 마이클 뉴도우씨가 제기했던 소는 결국 지난해 연방 대법원에 올려졌으나 대법원은 "뉴도우씨는 초등학교에 다니는 딸을 대신해 소를 제기했지만 딸의 후견권을 갖고 있지 않기 때문에 원고로 부적격하다"면서 기각했었다. 변호사이자 의사인 뉴도우씨는 당시 3명의 학부모 및 학생을 대표해 제소했음에도 대법원이 거부했었는데, 칼튼 판사는 이날 "그들 가족 모두 제소할 권리를 갖는다"면서 대법원에 정면으로 맞선 판결 배경을 설명했다. 칼튼 판사는 이어 새크라멘토 카운티 엘크그로브 통합교육구와 리오 린다 및 엘버타 조인트 초등학교 교육구에 대한 충성 맹세 선언 금지명령에 서명할 것이라고 덧붙였다. 한편 종교단체인 베켓펀드는 연방 제9순회 항소법원에 곧 항소할 것이라고 밝혔다. isjang@yna.co.kr http://blog.yonhapnews.co.kr/isjang/ (끝) <저 작 권 자(c)연 합 뉴 스. 무 단 전 재-재 배 포 금 지.>   ----------------------------- *첨부 2 [특파원 쪽지] 美 ‘국기에 대한 충성맹세’ 違憲 판결 [조선일보 2005.09.16 02:48:40]         [조선일보]미국 대부분의 공립학교에서는 학생들이 수업시간에 성조기를 향해 가슴에 손을 얹고 “나는 미합중국 국기 앞에 충성을 맹세한다”로 시작하는 충성맹세문을 외우도록 되어 있다. 버지니아주는 법률로 정해져, 초등학생은 첫 교시 시작 직후에, 중학생은 마지막 수업 끝나기 직전에 일제히 자리에서 일어서서 충성맹세문을 읽고 있다. 다만 외국인이나 스스로 낭송을 거부하는 학생은 읽지 않아도 된다. 일어서기는 하되 충성맹세문을 읽지는 않는다는 한 한국인 7학년생(중학교 1학년)은 그 이유에 대해 “조국이 따로 있기 때문”이라고 말했다. 미국 학교에서 이루어지는 이 ‘충성맹세’가 위헌(違憲)이라는 판결이 내려졌다. 캘리포니아주 새크라멘토시 연방법원의 로런스 칼튼 판사는 14일, 학생들이 낭송하는 충성맹세문 가운데 ‘하느님의 가호 아래 하나의 국가(one nation under God)’라는 부분은 헌법의 정교(政敎)분리 원칙에 어긋난다고 판결했다. 칼튼 판사는 이 같은 낭송이 “신의 인정에 대한 강압적 요구에서 자유로운 학생들의 권리를 침해했다”고 말했다. 이번 판결에 미국 전체가 영향을 받지는 않지만, 오랜 논쟁거리였던 이 문제가 새삼 촉발되는 계기가 될 것으로 보인다. 소송을 제기한 무신론자(無神論者)이자 변호사인 마이클 뉴도씨는 “만일 학교에서 거꾸로 ‘우리는 신의 존재를 부인하는 하나의 나라’라는 맹세문을 읽게 하면 사람들이 가만히 있겠느냐”고 반문했다. 미국 사회에 비(非)기독교 이민자가 증가하는 것도 이 같은 판결을 가져온 한 요인으로 보인다. The case was brought by the same atheist whose previous battle against the words "under God" was rejected last year by the Supreme Court on procedural grounds. U.S. District Judge Lawrence Karlton ruled that the pledge's reference to one nation "under God" violates school children's right to be "free from a coercive requirement to affirm God." Karlton said he was bound by precedent of the 9th U.S. Circuit Court of Appeals, which in 2002 ruled in favor of Sacramento atheist Michael Newdow that the pledge is unconstitutional when recited in public schools. CBS News Correspondent Wyatt Andrews reports that last year, the Supreme Court ducked a direct ruling because it said Newdow lacked custody of his daughter, he lacked the standing to sue. Newdow, an attorney, simply found two parents who do have custody and now he's back in business. Newdow, an attorney and a medical doctor, filed an identical case on behalf of three unnamed parents and their children. Karlton said those families have the right to sue. "Imagine every morning if the teachers had the children stand up, place their hands over their hearts, and say, 'We are one nation that denies God exists,"' Newdow said in an interview with AP Radio after the ruling. "I think that everybody would not be sitting here saying, 'Oh, what harm is that.' They'd be furious. And that's exactly what goes on against atheists. And it shouldn't." Karlton, ruling in Sacramento, said he would sign a restraining order preventing the recitation of the pledge at the Elk Grove Unified, Rio Linda and Elverta Joint Elementary school districts in Sacramento County, where the plaintiffs' children attend. The order would not extend beyond those districts unless it is affirmed by the 9th Circuit, in which case it could apply to nine western states, or the Supreme Court, which would apply to all states. The decision sets up another showdown over the pledge in schools, at a time when the makeup of the Supreme Court is in flux. CBS News Legal Analyst Andrew Cohen says of the high court, "they have to rule on the merits, they have to make a decision one way or another to give guidance to all these lower courts and all these school districts." Wednesday's ruling comes as Supreme Court nominee John Roberts faces day three of his confirmation hearings before the Senate Judiciary Committee. He would succeed the late William H. Rehnquist as chief justice. In July, Sandra Day O'Connor announced her plans to retire when a successor is confirmed. The Becket Fund, a religious rights group that is a party to the case, said it would immediately appeal the case to the San Francisco-based 9th U.S. Circuit Court of Appeals. If the court does not change its precedent, the group would go to the Supreme Court. "It's a way to get this issue to the Supreme Court for a final decision to be made," said fund attorney Jared Leland. The decisions by Karlton and the 9th Circuit conflict with an August opinion by the 4th U.S. Circuit Court of Appeals in Richmond, Va. That court upheld a Virginia law requiring public schools lead daily Pledge of Allegiance recitation, which is similar to the requirement in California. A three-judge panel of that circuit ruled that the pledge is a patriotic exercise, not a religious affirmation similar to a prayer. "Undoubtedly, the pledge contains a religious phrase, and it is demeaning to persons of any faith to assert that the words `under God' contain no religious significance," Judge Karen Williams wrote for the 4th Circuit. "The inclusion of those two words, however, does not alter the nature of the pledge as a patriotic activity." Karlton, appointed to the Sacramento bench in 1979 by President Carter, wrote that the case concerned "the ongoing struggle as to the role of religion in the civil life of this nation" and added that his opinion "will satisfy no one involved in that debate." Karlton dismissed claims that the 1954 Congressional legislation inserting the words "under God" was unconstitutional. If his ruling stands, he reasoned that the school children and their parents in the case would not be harmed by the phrase because they would no longer have to recite it at school. "All it has to do is put the pledge as it was before, and say that we are one nation, indivisible, instead of dividing us on religious basis," Newdow said.
